1. Definitions

• “Products” means digital documents, templates, toolkits, and any other downloadable or accessible materials sold or provided by Umhlabatea.
• “SENTINEL” means the AI-powered OHS compliance intelligence system accessible via this website.
• “User” means any individual or entity that accesses this website or purchases a Product.

2. Digital Product Licence

Upon successful purchase of a Product, Umhlabatea grants you a non-exclusive, non-transferable, perpetual licence to use the Product for your own internal business purposes.

• You may not resell, redistribute, sublicence, or share Products with third parties.
• You may not remove copyright or attribution notices from Products.
• Modification of Products for internal use is permitted; modified versions may not be distributed.
• Purchases are final. Refunds are considered on a case-by-case basis within 7 days of purchase — contact our contact form.

3. SENTINEL Intelligence Disclaimer

The SENTINEL OHS intelligence system provides information based on South African occupational health and safety legislation. SENTINEL's responses do not constitute legal or professional advice.

• You must independently verify any compliance decisions with a qualified OHS practitioner, legal professional, or competent person as defined under the OHS Act.
• Umhlabatea makes no warranty that SENTINEL responses are complete, current, or free from error.
• Umhlabatea is not liable for any loss, penalty, or consequence arising from reliance on SENTINEL output without independent verification.

4. Products Not a Substitute for Professional Advice

Our OHS document templates are designed to meet common compliance requirements under South African legislation. However, every site and operation has unique characteristics. You remain responsible for:

• Customising templates to your specific site conditions and hazards.
• Ensuring documents are reviewed by a competent person before use.
• Keeping documents current as legislation changes.

5. Intellectual Property

All content on this website, including but not limited to text, design, graphics, and software, is the intellectual property of Umhlabatea (Pty) Ltd and is protected by South African copyright law. Unauthorised reproduction is prohibited.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Umhlabatea's total liability to you for any claim arising from use of our Products or SENTINEL shall not exceed the amount paid by you for the relevant Product in the 12 months preceding the claim.

7. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Disputes shall be referred to the courts of South Africa.
